The Tenancy Agreement

Why do we need a tenancy agreement?

The Tenancy Agreement is the legal contract which clearly sets out the terms of your tenancy with Mercian, making clear our responsibilities to you as your landlord and your responsibilities to us as our tenant.

What are the tenant's responsibilities under the Tenancy Agreement?

You must:

  • Pay your rent in full and in advance each week
  • Take care of your home

This includes:

  • Keeping your home clean and internal decoration in good order
  • Not causing any damage to your home
  • Keeping your garden tidy and free of rubbish
  • Keeping your home in good repair. (This means letting us know quickly if we need to carry out any repairs, or carrying out your own repairs where these are your responsibility)
  • Live peacefully in your home and allow your neighbours to do the same. You should not use your home for any illegal or immoral purpose or run a business from it
  • Not cause, nor allow members of your household nor your visitors to cause any act or threat of violence, annoyance or harassment on the grounds of race, colour, religion, disability, sex or sexual orientations, to any person living in, or visiting your development.

If you need any advice about this, or are aware of such behaviour, please contact your Neighbourhood Officer straight away.

  • Ensure that the behaviour of everyone that lives with you or visits you does not cause a nuisance or annoyance to anyone. This includes any pets you or they may have
  • Not play any audio equipment or instrument so loudly that it can be heard outside your home
  • Obtain Mercian's written consent if you wish to keep a pet
  • Pay suppliers for services you use i.e. gas, electricity and council tax.
    Give four weeks notice in writing to end your tenancy
  • Keep in good condition any furniture provided with your tenancy

What are Mercian's responsibilities as your Landlord?

We will:

  • Allow you to live peacefully in your home without interference from us, as long as you do not break any tenancy conditions
  • Carry out repairs to the structure of your home and to Mercian's fixtures and fittings within set timescales
  • Allow you to carry out your own improvements and alterations, where you have asked our permission and agreed to certain conditions
  • Keep communal gardens and any other communal areas tidy and well maintained
  • Allow you to take over the tenancy if your partner dies
  • Allow you to take in lodgers, as long as you have our permission
  • Allow you to exchange with another tenant of any landlord providing you have our permission
  • Give you general information on our housing management services
  • Give you the right to complain if you are not satisfied with any aspect of our service
  • Give you access to information which we hold about you
  • Consult you on any changes we intend to make to our service
